Using the service
By using MuseumPortraits, you agree to use the site only for lawful purposes and in line with these terms.
MuseumPortraits may change, suspend, or discontinue parts of the product, including styles, formats, checkout options, and availability, at any time.
Eligibility and accounts
You may browse the site without an account. An account is used for profile settings and saved portrait galleries.
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account.
Photos, prompts, and customer content
You keep ownership of the images and other materials you submit, but you grant MuseumPortraits the rights needed to host, process, adapt, generate, display, reproduce, and complete the resulting portrait product.
You promise that you have the rights and permissions needed to upload the material you submit and that your uploads do not violate any person’s rights, any law, or these terms.
- Do not upload unlawful, infringing, deceptive, abusive, or harmful material.
- Do not upload content that violates privacy, publicity, or intellectual-property rights.
- Do not try to interfere with the product, bypass safeguards, scrape the service, or probe the system for vulnerabilities.
Portrait results
MuseumPortraits offers a creative, technology-assisted service. Portraits are stylized outputs based on the source material you provide, and results may vary depending on image quality, composition, subject visibility, and selected options.
You are responsible for reviewing previews and selections before you approve a portrait or complete a purchase.
Pricing and payment
Prices, product availability, and currencies may change. Taxes, duties, and local costs may also vary by destination and are your responsibility unless the checkout experience states otherwise.
MuseumPortraits is the customer-facing merchant of record for orders placed through the site unless the checkout experience clearly states otherwise.
Payments are processed through third-party providers. An order is not final until payment is accepted and MuseumPortraits has created the corresponding order record.
A contract for your order is formed when MuseumPortraits accepts the order by successfully taking payment and issuing order confirmation or otherwise creating the corresponding order record. MuseumPortraits may decline or cancel an order before that point.
Custom orders, cancellations, and refunds
Custom portrait products are made to order. If you need help before a paid order moves forward, contact MuseumPortraits as quickly as possible. Depending on the current order state, the team may be able to help with a correction or cancellation.
For custom goods made to your specification or clearly personalized for you, statutory cancellation or cooling-off rights that may otherwise apply to distance purchases may not apply, except where applicable law requires otherwise.
Once a custom order has moved forward, MuseumPortraits will usually treat the sale as final except where required by law or where the order is materially incorrect or unavailable because of a service issue.
If you purchase digital content for immediate access or download, you expressly consent to supply beginning immediately and acknowledge that any statutory cancellation or cooling-off right you may otherwise have can be lost once digital delivery begins, except where applicable law requires otherwise.
Digital portrait purchases and delivered digital files are generally non-refundable once access has been granted, except where the law requires otherwise or MuseumPortraits determines there was a clear service failure.
Timing depends on third-party service providers. Any timing shown on the site is an estimate unless MuseumPortraits expressly states otherwise.
If MuseumPortraits cannot complete an order within a stated timeframe or, where no specific timeframe is stated, within a commercially reasonable period, MuseumPortraits may notify you of the delay, provide an updated estimated timeframe, and where required by applicable law offer cancellation, replacement, credit, or refund.
MuseumPortraits remains the customer-facing merchant for support questions and refund decisions, even when a third-party service provider is involved in completing the order.
If an order appears delayed or unavailable, MuseumPortraits may investigate with its service providers and decide whether a replacement, store credit, partial refund, or full refund is appropriate.
MuseumPortraits may decline refund requests based only on changes of mind, personal taste, or generalized dissatisfaction where the delivered portrait matches the approved custom order.
- If an order is not materially consistent with the approved order, contact MuseumPortraits promptly with the order number and a clear description of the issue.
- MuseumPortraits may ask for additional information and may require that support instructions be followed for any claim involving a service provider.
Digital files and order access
Portrait access is provided through the style order page and profile gallery surfaces. Access may depend on the email address used during checkout, account status, or the continued availability of the relevant asset.
MuseumPortraits may send secure order-access or sign-in links by email so customers can reopen the current portrait order or profile gallery.
Intellectual property
The MuseumPortraits website, branding, layout, copy, catalog content, workflows, and software are owned by MuseumPortraits or its licensors and are protected by applicable intellectual-property laws.
If you purchase a portrait and complete payment for it, MuseumPortraits grants you a non-exclusive, worldwide, perpetual license to use, display, download, reproduce, and share the delivered portrait for any lawful purpose.
Except for that license to your paid delivered portrait and the limited rights needed to use the service, these terms do not grant you any license to MuseumPortraits intellectual property.
Suspension and termination
MuseumPortraits may refuse service, suspend access, cancel accounts, or block orders if it believes a user has violated these terms, created legal risk, abused the platform, or threatened the security or reliability of the service.
Disclaimers and limits
To the maximum extent allowed by law, the service is provided on an as-available basis. MuseumPortraits does not promise uninterrupted operation, error-free performance, or that every generated or fulfilled result will match a customer’s subjective expectations.
To the maximum extent allowed by law, MuseumPortraits will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Any direct liability will be limited to the amount you paid for the specific order giving rise to the claim.
Governing law and venue
These terms and any dispute arising out of or relating to MuseumPortraits or an order placed through the site will be governed by the laws applicable at MuseumPortraits' principal business address, without regard to conflict-of-law rules, except to the extent mandatory consumer-protection law in your place of residence applies.
Unless applicable law requires otherwise, disputes will be resolved in the courts that have jurisdiction over MuseumPortraits' principal business address. Nothing in these terms limits any mandatory rights you may have to bring a claim in another forum where consumer law does not allow that limitation.
Updates to these terms
MuseumPortraits may revise these terms from time to time. Continued use of the service after an updated version becomes effective means you accept the revised terms.
